plaintiff filed an Amended Verified Class Action Complaint (the “Amended Complaint”), adding various allegations and seeking money damages instead of injunctive relief. On August 24, 2016, the Court of Chancery granted the defendants’ motions to dismiss the Amended Complaint in its entirety issued its opinion and also granted Old C&J’s motion to recover damages arising from the Injunction Order. On March 23, 2017, the Supreme Court issued an order affirming the Court of Chancery’s opinion. Plaintiff then filed a motion for attorneys’ fees and costs. On Tuesday, January 23, 2018, the Court of Chancery denied Plaintiff’s motion for attorneys’ fees and costs. 33 Item 4. Mine Safety Disclosures Not applicable.
